These Terms of Service ("Terms") govern your use of the Rookie Spitfire Discord bot, launcher application, website, and related services (collectively, the "Services"), operated by an individual developer ("we", "us", or "our"). By using our Services, you agree to these Terms in full.

1. Eligibility

You must be at least 13 years old (or 16 in the EU) to use our Services. By using the Services, you confirm that you meet this requirement. We reserve the right to terminate access for any account we believe to be operated by a minor below this age.

2. Use of the Services

You agree to use our Services only for their intended purpose and in compliance with all applicable laws and regulations, Discord's Terms of Service, and Epic Games' Terms of Service.

You agree not to:

  • Exploit bugs, glitches, or unintended behaviour in the Services for personal gain
  • Attempt to cheat or manipulate any feature of the Services
  • Resell, sublicense, or grant others access to your account or any premium features
  • Interfere with or disrupt the operation of the Services or our infrastructure
  • Use the Services in any way that violates the rights of others

3. Accounts & Access

You are responsible for maintaining the security of your account and any credentials associated with the Services. We are not liable for any loss or damage arising from unauthorised access to your account. We reserve the right to suspend or permanently terminate your access to the Services at any time, with or without notice, for any violation of these Terms.

4. Premium Subscriptions

Certain features of the Services are available through a paid premium subscription. By purchasing a subscription, you agree to the following:

  • All payments are processed by third-party payment providers. We do not store your payment details.
  • Subscriptions are personal and non-transferable. You may not share, resell, or grant access to premium features to any other person.
  • We reserve the right to modify, suspend, or discontinue premium features at any time.

5. Refunds

All purchases are final. Refunds are only issued where required by applicable law. Where a refund is legally required, it must be requested within 24 hours of purchase. Refund requests submitted after this period will not be accepted. We reserve the right to revoke premium access upon issuing a refund.

6. Termination

Any violation of these Terms may result in the immediate and permanent termination of your access to the Services without prior warning. This includes but is not limited to cheating, exploiting, or reselling access. We are not obligated to provide a reason for termination, and no refund will be issued in the event of a termination for breach of these Terms.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components. Your use of the Services is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

9. Third-Party Account Risk

The use of our Services, including the Discord bot and launcher, may interact with your Epic Games account in ways that violate Epic Games' Terms of Service. By using our Services, you acknowledge and accept that:

  • Your Epic Games account may be suspended, banned, or otherwise penalised as a result of using our Services.
  • You assume full and sole responsibility for any consequences to your Epic Games account or any other third-party account arising from your use of our Services.
  • We are not affiliated with, endorsed by, or in any way responsible for the actions of Epic Games or any other third party.
  • We shall not be liable for any loss, including loss of account access, in-game items, purchases, or progress, resulting from account action taken by Epic Games or any other third party.

10. Third-Party Services

Our Services interact with third-party platforms including Discord and Epic Games. We are not responsible for the availability, content, or practices of these platforms. Your use of third-party services is subject to their respective terms and policies.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Services shall be resolved in the appropriate jurisdiction.
